Abstrak
The formation of Indonesia’s Constitutional Court in 2003 delivered new hope for the protection of human rights in Indonesia. Armed with the authority of judicial review, the Court has annulled provisions of laws that impeded and violated human rights. The Court has also frequently issued constitutional interpretations to overcome legal deadlocks or vacuums. With a wealth of knowledge and experience in the workings of Indonesia’s constitutional law system, the authors illuminate the problems of upholding human rights and the Constitutional Court’s efforts to resolve them. Readers will discover the challenges and implications resulting from the Court’s decisions, which have colored the development of human rights in Indonesia.
